| Általános Szerződési Feltételek (a továbbiakban: ÁSZF) 1.1. Az ÁSZF 2026.07.01-től hatályos. A BOMBUSBRAND fenntartja a jogot arra, hogy az általános szerződési feltételeket egyoldalúan módosítsa. A WEBÁRUHÁZ HASZNÁLATA 2.1. Rendelési folyamat A szerződés megkötéséhez a következő lépéseket kell tenni: Termék kiválasztása és kosárba helyezése A termékek lényeges tulajdonságairól és az ellenszolgáltatás adóval megnövelt teljes összegéről (szállítási költség nélkül) a webáruházban talál részletes információt. A BOMBUSBRAND törekszik rá, hogy a termékekről készült képek a valóságnak megfeleljenek, azonban felhívjuk a figyelmet arra, hogy a különböző eszközökön eltérően jelenhetnek meg a képek, például előfordulhat, hogy a kép mérete torzul, így a ruha szabása másnak tűnhet vagy a termék színét a valóságnak nem megfelelően jelenti meg az Ön eszköze. A webáruházban kiválaszthatja a megvásárolni kívánt termékeket, a méretet, színt és a mennyiséget. Lehetőség van egy vagy több termék vásárlására is ugyanazon rendelési folyamat során. A kívánt termékek és adatok kiválasztása után a kosárba helyezheti a termékeket. A kosár tényleges tartalmát a Kosár ikonra kattintva ellenőrizheti. A Kosárban a Törlés vagy Frissítés ikonra kattintva szabadon törölhet bármely terméket, vagy módosíthatja a mennyiséget. Felhívjuk figyelmét, hogy a kiválasztott termékek kosárba helyezésével nincsenek az Ön számára fenntartva, és más vásárlók is megvásárolhatják azokat. Rendelés leadása A kosárban a „Checkout” ikonra kattintva leadhatja rendelését. Ezt követően meg kell adnia a weboldalon a számlázási és szállítási adatait. A rendelési folyamat során Ön felelős azért, hogy a megadott információk igazak, pontosak és teljesek legyenek. A BOMBUSBRAND nem vállal felelősséget az Ön adataiban a megrendelt termékek kiszállítása előtt bekövetkezett változásokért. Rendelés leadásakor feltüntetjük a kiválasztott terméket, annak árát és az alkalmazandó szállítási díjat (ha van ilyen). Ön a szerződési nyilatkozatának megtételekor kifejezetten tudomásul veszi, hogy nyilatkozata fizetési kötelezettséget von maga után. A BOMBUSBRAND jogosult elutasítani a webáruházban leadott összes olyan rendelést, amelynek célja az Ön vagy bármely harmadik fél kereskedelmi tevékenységének támogatása. A BOMBUSBRAND a webáruházban csak kis mennyiségben értékesíti termékeit. Kereskedelmi kérdésekkel forduljon közvetlenül a BOMBUSBRAND-hez e-mailben: info@bombusbrand.com Rendelés véglegesítése és fizetés A rendelés véglegesítése során mindig lehetősége van a korábban megadott információk szerkesztésére. A szállítás a megadott szállítási címre történik, azonban Magyarországon belül lehetőség van csomagautomatába történő szállításra is, amennyiben a „Note (optional)” rubrikában pontosan megjelölésre kerül a csomagautomata szolgáltatója és címe. Amennyiben a csomagautomata nem azonosítható be, a szállítási címre történik a szállítás. Az ÁSZF és az adatvédelmi tájékoztató elfogadását követően a termék teljes árát a „PLACE ORDER” gombra kattintva online fizetheti ki. Rendelés visszaigazolása A rendelés leadása és fizetése után haladéktalanul e-mailben kap egy rendelési visszaigazolást, amely tartalmazza a vásárlás összefoglalását, beleértve a rendelésszámot is. Felhívjuk figyelmét, hogy a BOMBUSBRAND nem vállal felelősséget a visszaigazolás elmaradásáért vagy a késedelmes visszaigazolásért, ha az a rendelési folyamat során megadott helytelen e-mail cím, az e-mail fiók megteltsége vagy az Ön oldalán felmerülő egyéb technikai problémák miatt következik be. Felhívjuk figyelmét, hogy a BOMBUSBRAND fenntartja a jogot, hogy: elutasítsa a már visszaigazolt rendeléseket. Ebben az esetben a BOMBUSBRAND haladéktalanul tájékoztatja Önt, és haladéktalanul, de legkésőbb 30 (harminc) napon belül visszatéríti az Ön által már kifizetett teljes összeget.javítsa ha a webáruházban bármilyen hiba merül fel a termékekkel vagy az árakkal kapcsolatban. Ilyen esetben a BOMBUSBRAND haladéktalanul tájékoztatja Önt az új adatokról. Ezt követően ismét megerősítheti rendelését, vagy bármelyik fél jogosult elállni a szerződéstől. saját belátása szerint korlátozza vagy törölje a vásárlónként vagy címenként vásárolt mennyiségeket. Ilyen esetekben a BOMBUSBRAND haladéktalanul tájékoztatja Önt. A BOMBUSBRAND minden tőle telhetőt megtesz annak érdekében, hogy a webáruház árai pontosak legyenek, ha azonban ennek ellenére hibás árak jelennének meg, a BOMBUSBRAND nem köteles a terméket a hibás áron értékesíteni. Ilyen esetben a terméket felkínálhatjuk Önnek a helyes áron, Ön pedig jogosult a szerződéstől elállni. Hibás különösen az az ár többek között, amely nyilvánvalóan hibás vagy aránytalan. Szállítás, szállítási költségek, vámok és adók A megrendelt terméket a rendelési folyamat során megadott szállítási címre szállítjuk. Magyarországon belül lehetőség van csomagautomatába történő szállításra is, amennyiben a „Note (optional)” rubrikában a vásárló által pontosan megjelölésre kerül a csomagautomata szolgáltatója és címe. Amennyiben a csomagautomata nem azonosítható be, a szállítási címre történik a szállítás. A szállítási költség a szállítási cím alapján kerül automatikusan kalkulálásra. A megrendelt termék ára az adókat tartalmazza, az esetlegesen kiszabott vámokat nem tartalmazza. A termékek kiszállításáról e-mailben is visszaigazolást kap. Beviteli hibák javítása A rendelési folyamat során lehetősége van a beviteli hibák javítására a rendelés véglegesítéséig és a fizetésig (pl. a kosár frissítésével vagy bármely tétel törlésével a kosárból). 2.3. Egyéb információk a rendelési folyamattal kapcsolatban, továbbá az értékesítés utáni szolgáltatásokról Az Ön és a BOMBUSBRAND közötti szerződéses kapcsolat kizárólag elektronikus formában jön létre, a termék átvételével a szerződés teljesítettnek minősül. A termékkel kapcsolatban esetlegesen felmerült kérdéseit az order@bombusbrand.com e-mail címen teheti fel. A jelen ÁSZF angol és magyar nyelven áll rendelkezésére. Jogvita vagy értelmezési problémák esetén a magyar nyelvű változat az irányadó. USAGE OF THE WEBSHOP 2.1. Ordering Process The following steps are required to conclude the contract: Selection of the Product(s) and adding to the Cart Detailed information regarding the essential characteristics of the products and the total price, including taxes (but without delivery costs), is available in the Webshop. BOMBUSBRAND endeavors to ensure that images of the products accurately reflect reality; however, please note that images may appear differently on various devices. For example, the size of the image may be distorted, which can make the cut of a garment appear different, or your device may display the product’s color inaccurately compared to its actual appearance. In the Webshop, you can also select the products to be purchased, along with the size, colour, and quantity. You may purchase one or more products during the same ordering process. After selecting the required products and data, you can add the products to the Cart. The actual contents of the Cart can be checked by clicking on the Cart icon. In the Cart, you can freely delete any product or modify the quantity by clicking on the Delete/Remove or Update icon. Please note that by adding the selected products to the Cart, these are not reserved for you and may be purchased by other customers. Placing an Order You can place your order by clicking the “Checkout” icon in your Cart. After this, you must provide your billing and delivery information on the website. During the ordering process, you are responsible for ensuring that the information you provide is true, accurate, and complete. BOMBUSBRAND shall not be liable for any changes in your data occuring prior to the delivery of the ordered products. When placing an order, the selected product, its price and the applicable delivery costs (if any) will be indicated. By submitting your order, you expressly acknowledge that your order constitutes a binding commitment to pay. BOMBUSBRAND reserves the right to reject any order placed in the Webshop that is intended to support Your or third party’s commercial activities. BOMBUSBRAND sells its products in the Webshop only in limited quantities. Delivery will be made to the specified delivery address; however, within Hungary, delivery to a parcel locker is also available, if the parcel locker provider and address are clearly indicated in the “Note (optional)” field. If the parcel locker cannot be identified, delivery will be made to the delivery address. Following the acceptance of the General Terms and Conditions and the Privacy Policy, the full purchase price of the Product may be paid online by clicking the ‘PLACE ORDER’ button. Order Confirmation Following the placement of the order and completion of the payment, You shall receive an order confirmation via email without undue delay, which shall contain the summary of Your purchase, including the order number. Please note that BOMBUSBRAND shall not be liable for non-confirmation or delayed confirmation, if it is due to an incorrect e-mail address provided by you during the ordering process, or if your e-mail inbox is full or in case of any other technical issues emerging on your side. Please note that BOMBUSBRAND reserves the right to: refuse any order which has been already confirmed. In such cases, BOMBUSBRAND shall inform you immediately and shall also refund the full amount what you have already paid without delay, but no later than within 30 (thirty) days.correct, in case any defect occurs in the Webshop in relation to the products or the prices. In such cases BOMBUSBRAND informs you about the new data without delay. Thereafter, You can confirm your order once again, or any party is entitled to withdraw from the contract. limit or cancel the quantities purchased per customer or per postal address – in its sole discretion. In such cases, BOMBUSBRAND shall inform you without delay. BOMBUSBRAND shall make all reasonable efforts to ensure that the prices indicated in the Webshop are accurate. In such cases, the Product may be offered to the Customer at the correct price, and the Customer shall be entitled to withdraw from the contract. Without limitation, a price shall be deemed incorrect if it is manifestly erroneous or disproportionate. Delivery, delivery costs, duties and tax The ordered product shall be delivered to the delivery address provided by You during the ordering process. Within Hungary, delivery to a parcel locker is also available, if the parcel locker provider and address are clearly indicated in the “Note (optional)” field. If the parcel locker cannot be identified, delivery will be made to the delivery address. Delivery costs are automatically calculated based on the delivery address. The price of the ordered product includes taxes but does not include any customs duties that may be imposed. You will also receive an email confirmation regarding the delivery of the products. For further information regarding delivery terms, please see below Section 4 of the present GTC (“Delivery Policy”). 2.2. Correcting input errors All along the ordering process, You have the possibility to correct all input errors until the order completion and payment (e.g. by updating your Cart or deleting any product from your Cart). 2.3. Other information in relation with the ordering process and after-sales services The contractual relationship between You and BOMBUSBRAND shall be established exclusively in electronic form, the contract shall be deemed fulfilled upon receipt of the product. You may direct any questions regarding the product to the email address order@bombusbrand.com . These GTC are available in English and Hungarian. In the event of legal dispute or issues of interpretation, the Hungarian version shall prevail. Please note that BOMBUSBRAND reserves the right to suspend or refuse the sale of goods or the provision of services if you intend to purchase or use such goods or services in contradiction with the provisions of these GTC. |
| 3. FIZETÉSI FELTÉTELEK 3.1. Fizetendő összegek A megrendelés teljesítéséhez a következő összegeket kell fizetni a megrendelt termékkel kapcsolatban: a termék vételára, amely tartalmazza a szállításra alkalmas csomagolást, és az alkalmazandó szállítási díjak (ha vannak ilyenek), külön feltüntetve. A Webáruházban feltüntetett vételár és szállítási díjak bruttó összegek. Az EU-n kívüli célországok esetében azonban a szállítási díjak nem tartalmazzák az ezen országok által kivetett vámokat, adókat vagy vámkezelési díjakat. Ezek a díjak az Ön felelősségi körébe tartoznak, és országonként eltérőek lehetnek. A BOMBUSBRAND nem tudja előre meghatározni, hogy milyenek lesznek ezek a díjak. A díjakat a célország vámhatósága közvetlenül a vevőnek számlázhatja ki, vagy a szállítmányozó cégen keresztül számlázhatja ki a vevőnek. A BOMBUSBRAND azt javasolja, hogy hívja fel a helyi vámhivatalt, ha további információra van szüksége az Ön országában érvényes vámokról. 3.2. Pénznemek és fizetési mód A webáruházban az alapértelmezett pénznem az EURO. Amennyiben a rendelését az order@bombusbrand.com e-mail címen – tehát a webáruházon kívül – adja le, úgy lehetőség van a FORINT-ban történő fizetésre is. Ebben az esetben az ÁSZF értelemszerűen szintén irányadó. A rendelés folyamán az order@bombusbrand.com e-mail címre az alábbi adatokat szükséges megküldeni: Név, számlázási cím, szállítási cím (Magyarországon belüli csomagautomata esetén a csomagautomata szolgáltatójának és címének pontos megjelölése), e-mail cím, telefonszám. Az e-mailben nyilatkozni kell az ÁSZF és az adatvédelmi szabályzat elfogadásáról („Elolvastam és elfogadom az ÁSZF-et és az adatvédelmi szabályzatot.”), továbbá arról, hogy promóciós e-maileket és különleges ajánlatokat szeretnének-e kapni. A megrendelést követően a BOMBUSBRAND kiállítja az utalásos számlát FORINT pénznemben. A termékek vételára FORINTBAN történő fizetés esetén is előre megismerhető, közzétételre kerül egy árlista a BOMBUSBRAND social média oldalain és a weboldalon is, a számla a rendelés és az árlista alapján kerül kiállításra. A fizetés a WooCommerce webáruház-rendszerhez fejlesztett WooPayments online fizetési szolgáltatáson keresztül történik, ami a hattérben a Stripe fizetési infrastruktúráját használja. A BOMBUSBRAND elfogadja a VISA, MasterCard/Maestro és American Express bankkártyákat, és a digitális pénztárcákon (Apple Pay és Google Pay) keresztül történő fizetést, valamint minden olyan egyéb fizetési módot, amelyet kifejezetten feltüntet a webáruházban. Felhívjuk figyelmét, hogy a BOMBUSBRAND nem vállal felelősséget a késedelemért vagy a kézbesítés elmaradásáért abban az esetben, ha a bankkártya kibocsátója megtagadja a BOMBUSBRAND részére történő fizetés engedélyezését. 3.3. Egyéb kérdések A számla kizárólag e-mailben kerül megküldésre, papíralapon nem kerül kibocsátásra. Kérjük, ne nyomtassa ki. A BOMBUSBRAND nem vállal felelősséget a megrendelés és a szállítás megtagadásáért, ha a Webáruházban egyértelműen hibás adatokkal rendelték meg a terméket. | 3. PAYMENT TERMS 3.1. Amounts to be paid For the completion of your order, the following amounts shall be paid in connection with the ordered product: the purchase price of the product which includes the packaging suitable for delivery, and the applicable delivery costs (if any), displayed separately. The purchase price and delivery fees indicated in the Webshop are gross amounts. However, for destination countries outside the EU, the delivery costs do not include any duties, taxes, or customs clearance fees imposed by these countries. These charges are falling under Your responsibility and may vary by country. BOMBUSBRAND cannot predetermine these charges. The charges may be billed directly to the customer by the customs authority of the destination country, or may be billed to the customer through the shipping company. BOMBUSBRAND recommends contacting the local customs office for further information regarding the applicable customs duties in Your country. 3.2. Currencies and payment method The default currency in the Webshop is EURO. If You place your order via email at order@bombusbrand.com – that is, outside the Webshop -, you also have the option to pay in HUF. In this case, these GTC shall also apply accordingly. When placing an order, you must send the following information to the order@bombusbrand.com email address: Name, billing address, delivery address (for parcel lockers within Hungary, please specify the parcel locker provider and exact address), email address, phone number. In the email, you must declare your acceptance of the General Terms and Conditions and the Privacy Policy (“I have read and accept the General Terms and Conditions and the Privacy Policy”), as well as whether you wish to receive promotional emails and special offers. Following the placement of the order, BOMBUSBRAND shall issue an invoice payable by bank transfer in Hungarian FORINT. The purchase price of the products shall be available in advance including in cases where payment is made in HUF; a price list shall be published on BOMBUSBRAND’s social media pages and on the website, and the invoice shall be issued based on the order and the applicable price list. Payment is processed via the WooPayments online payment service, developed for the WooCommerce e-commerce platform, which uses the Stripe’s payment infrastructure in the background. BOMBUSBRAND accepts payments by VISA, MasterCard/Maestro, and American Express credit cards, as well as via digital wallets (Apple Pay and Google Pay), and any other payment methods explicitly listed in the Webshop. Please note that BOMBUSBRAND is not liable for any delay or failure in delivery if the credit card issuer refuses to authorize payment to BOMBUSBRAND. 3.3. Other questions The invoice will be sent exclusively by email; no paper invoice will be issued. Please do not print the invoice. BOMBUSBRAND assumes no liability for the refusal of an order or delivery if the product was ordered through the Webshop using clearly incorrect information. |
| 4. SZÁLLÍTÁSI SZABÁLYZAT 4.1. Általános információk a szállításról A BOMBUSBRAND világszerte szállít. Postafiók címre történő szállítás nem lehetséges. 4.2. Szállítási díjak és kézbesítési idők Az alkalmazandó szállítási díjak a következők: Magyarország: 7 EURO Magyarországon kívüli európai országok: 18 EURO Európai országokon kívüli országok: 25 EURO A szállítási díjak nem tartalmazzák a Magyarországon kívüli országok által kivetett vámokat, adókat vagy vámkezelési díjakat. Ezek a díjak az Ön felelősségi körébe tartoznak, és országonként eltérőek lehetnek. Az alkalmazandó szállítási idők a következők: 1-10 munkanap VAGY A részletes és ténylegesen alkalmazandó szállítási feltételek a webáruházban találhatók. A BOMBUSBRAND törekszik a megrendelés teljesítésére a megadott határidőn belül, de nem vállal felelősséget, ha a szállítási idő hosszabb a megadottnál, és nem vállal felelősséget a rajta kívül álló okokból eredő késedelmes szállításokért. A BOMBUSBRAND mindent megtesz, hogy tájékoztassa Önt minden váratlan késedelemről. Felhívjuk figyelmét, hogy a fenti szállítási idők nem tartalmazzák a szombatot, vasárnapot, valamint a nemzeti ünnepeket/bank ünnepnapokat és Magyarország egyéb munkaszüneti napjait. 4.3. Szállítási díjak visszaküldés esetén A BOMBUSBRAND-hez történő termékvisszaküldés esetén, igény szerint, a BOMBUSBRAND futárszolgálatot rendel meg Önnek a visszaküldött csomag szállításához, azonban a szállítási költségek megfizetése Önt terhelik. Csupán a folyamat megkönnyítését szeretnénk biztosítani Önnek. Hibás termék visszaküldése esetén a visszaküldéssel kapcsolatos szállítási díjat a BOMBUSBRAND fizeti. Továbbá vásárlónként maximum egy alkalommal méretcsere (egyszeri ingyenes méretcsere 5.4.2. pont)esetén is vállalja a BOMBUSBRAND a szállítási költségek megfizetését, amennyiben van a készleten Önnek megfelelő méretű termék. Ebben az esetben a BOMBUSBRAND nem téríti vissza a termék vételárát, annak egy részét vagy a különbözetet. Visszatérítés kérése esetén ez a visszaküldési mód nem vehető igénybe, a BOMBUSBRAND nem vállalja a visszaküldés díjának megfizetését. Továbbá felhívjuk a figyelmét, hogy a méretcsere és a visszaküldés vonatkozásában előzetesen egyeztetni szükséges az order@bombusbrand.com e-mail címen. | 4. DELIVERY POLICY 4.1. General information regarding delivery BOMBUSBRAND delivers worldwide. Delivery to a P.O. box is not possible. 4.2. Delivery costs and delivery times The applicable delivery costs are the following: Hungary: 7 EUR European countries outside Hungary: 18 EUR Countries outside Europe: 25 EUR Delivery costs do not include customs duties, taxes, or customs clearance fees imposed by countries outside Hungary. BOMBUSBRAND will make every reasonable effort to inform the Customer of any unexpected delays. Please note that the delivery times listed above do not include Saturdays, Sundays, national holidays/bank holidays, or other public holidays in Hungary. 4.3. Delivery costs in case of returns In the event of returning a product to BOMBUSBRAND, upon request, BOMBUSBRAND shall order a courier service for You to deliver the returned package; however, you are responsible for paying the delivery costs. We simply want to make the process easier for You. In the event of returning a defective product, BOMBUSBRAND shall cover the delivery costs regarding the return. Furthermore, BOMBUSBRAND shall cover the delivery costs for a size exchange once per customer (the one-time free size exchange, please see Section 5.4.2), only if the product in the requested size is available in stock. In this case, BOMBUSBRAND shall not refund the purchase price of the product, any part thereof, or any price difference. If a refund is requested, this return method shall not be applicable, and BOMBUSBRAND shall not be liable for the delivery costs of return. Furthermore, please note that prior consultation regarding the size exchange and the return, is required via the email address at order@bombusbrand.com. |
| 5. VISSZAKÜLDÉSI SZABÁLYZAT 5.1. Elállási/felmondási jog Amennyiben fogyasztónak minősül, Ön elállási/felmondási joggal rendelkezik, amelyet a megrendelt termék kézhezvételétől számított 14 (tizennégy) napon belül indoklás nélkül bejelenthet. Ezt a jogot a fenti 14 (tizennégy) napos határidőn belül a BOMBUSBRAND order@bombusbrand.com e-mail címére vagy postai úton a 1135 Budapest, Szent László út 26. 2. emelet 27. Hungary címre küldött kifejezett nyilatkozatban jelezheti az 1. sz mellékletben található nyilatkozat-minta felhasználásával vagy egyéb egyértelmű nyilatkozattal, amiből megállapítható a kifejezett szándék az elállásra/felmondásra, és a rendelés kétséget kizárólag beazonosítható, és beazonosítható továbbá, hogy mely áru(k) vonatkozásában kíván az elállási/felmondási jogával élni. Ez esetben Ön köteles a kérdéses terméket haladéktalanul, de legkésőbb az elállás közlésétől számított 14 (tizennégy) napon belül visszaküldeni a BOMBUSBRAND-nek. Ezt a határidőt betartottnak kell tekinteni, ha a terméket a 14 (tizennégy) nap lejárta előtt feladja. Ön köteles a terméket az Ön által választott futárszolgálattal visszaküldeni, és Önt terheli a visszaküldés minden költsége. A BOMBUSBRAND nem fizeti a szállítási költségeket, kivéve, ha a termék hibás, és ez a visszaküldés oka. 5.2. Visszatérítések/Visszaküldések Amint a BOMBUSBRAND megkapja a visszaküldött terméket, minőségellenőrzési eljáráson esik át a visszaküldött termék megfelelőségének megállapítása érdekében. Felhívjuk figyelmét, hogy Ön felelős a termékek értékcsökkenéséért, amely a tulajdonságainak és működésének megállapításához szükséges használatot meghaladó használat eredményeként következik be. A fentieket meghaladó mértékben használt vagy sérült visszaküldött termékeket nem áll módunkban elfogadni, és a visszatérítést részben vagy egészben megtagadjuk. A BOMBUSBRAND a visszaküldött termék kézhezvételétől számított 30 (harminc) napon belül értesíti Önt a visszatérítés jóváhagyásáról vagy részleges/teljes elutasításáról, s jóváhagyás/részleges jóváhagyás esetén ezen határidőn belül visszatéríti az összeget. Elfogadás esetén a BOMBUSBRAND a csökkentett vagy teljes összeget (amelyet eredetileg a visszaküldött termékkel kapcsolatban fizetett) az eredeti fizetési móddal megegyező módon téríti vissza, kivéve, ha Ön más fizetési mód igénybevételéhez kifejezetten a hozzájárulását adja. Azonban, kivéve, ha a termék hibás, ez a visszatérítés nem tartalmazza a visszaküldéssel kapcsolatban Ön által fizetett szállítási költséget. Ezenkívül minden visszatérítés alapja a vásárolt termék eredeti ára, azaz akciós termék esetén a BOMBUSBRAND maximum az adott termék akciós árát tudja visszatéríteni. 5.2.1. VISSZAKÜLDÉS Sajnáljuk, hogy a termék nem felelt meg a várakozásainak! Ha ki szeretné cserélni vagy vissza szeretné küldeni a megrendelt terméke(i)t, ezt megteheti a termék kézhezvételétől számított 14 (tizennégy) napon belüli elállástól (5.1. pont) számított 14 (tizennégy) napon belül. Szeretnénk, ha visszajelezne a termékekkel kapcsolatban, hogy a visszajelzés alapján tudjuk fejleszteni a termékeinket! SZÁLLÍTÁSI KÖLTSÉGEK VISSZAKÜLDÉS ESETÉN A BOMBUSBRAND-hez történő visszaküldés esetén a visszaküldő köteles megfizetni a szállítási költségeket. A BOMBUSBRAND igény esetén, amennyiben Ön ezt előre jelzi, futárszolgálatot bíz meg a visszaküldési folyamat gördülékenyebbé és könnyebbé tételével, de ebben az esetben is a visszaküldőt terheli a szállítási költség. Hibás termék visszaküldése és egyszeri ingyenes méretcsere (5.4.2. pont) esetén a visszaküldéssel kapcsolatos szállítási díjat a BOMBUSBRAND fizeti. 5.2.3. FIZETENDŐ ÖSSZEGEK A visszaküldött termék szállítási költségein kívül egyéb vám-/adóköltségek is felmerülhetnek a küldemény Magyarországra történő megérkezésekor. A visszaküldő köteles fedezni a visszaküldéssel kapcsolatban felmerülő összes többletköltséget. A BOMBUSBRAND azt javasolja minden visszaküldőnek, hogy a csomag elküldése előtt hívja fel a helyi vámhivatalt, hogy további információkat kapjon a célország vámkötelezettségeivel kapcsolatban. | 5. RETURN POLICY 5.1. Right of Withdrawal/Cancellation If you qualify as a consumer, you have the right of withdrawal/cancellation which you may exercise without giving any reason within 14 (fourteen) days from the receipt of the ordered product. ((Hungary), using the model statement form set out in Annex 1 or by means of another clear and unambiguous statement from which your express intention to withdraw/cancel can be determined, and which enables the order to be clearly identified, as well as the specific product(s) to which the withdrawal/cancellation relates. In this case, you must return the concerned product to BOMBUSBRAND without delay, but no later than 14 (fourteen) days from the date of the announcement of the withdrawal. This deadline shall be considered met if the product is dispatched before the expiry of 14 (fourteen) days. You are obliged to return the product using a courier service chosen by you, and you shall bear all costs associated with the return. BOMBUSBRAND shall not cover any delivery costs unless the return is due to a defect in the product. 5.2. Refunds/Returns Upon receipt of the returned product, BOMBUSBRAND shall carry out a quality control procedure to determine the appropriateness of the returned product. Please note that the customer shall be liable for the depreciation of the products which resulting from the use of the product which exceeds the necessary measure in order to assess the characteristics / nature, and functionality of the product. Returned products that have been used (in excess of the above) or damaged may not be accepted and the refund may be partially or entirely refused. BOMBUSBRAND shall notify you of the approval or partial/full rejection of the refund within 30 (thirty) days from the receipt of the returned product. In case of approval/ partial approval the amount will be refund within this period. In case of acceptance, BOMBUSBRAND shall refund the reduced or full amount (which you originally paid in connection with the returned product) using the same payment method as the original payment, unless You expressly agree to the use of a different payment method. However, this refund shall not include any delivery costs paid by you in connection with the return, except where the return is due to a defective product. Furthermore, all refunds are based on the original price of the purchased product, that is, in the case of a discounted product, BOMBUSBRAND shall refund only maximum the discounted price of that product. 5.2.1. If you wish to exchange or return the ordered product(s), you can do so within 14 (fourteen) days from the date of receipt of the product, which corresponds to the fourteen (14) day withdrawal period referred to in Section 5.1. We welcome and appreciate any feedback regarding on our Products, as such feedback contributes to the continuous improvement and development of our Products. DELIVERY COSTS IN CASE OF RETURNS In the event of returning products to BOMBUSBRAND, the returner shall be responsible for covering the delivery costs. Upon prior request, BOMBUSBRAND may assist by arranging for a courier service to make the return process smoother and easier; however, in this case as well, the returner remains responsible for the delivery costs. In the case of returning a defective product or a one-time free size exchange (Section 5.4.2), BOMBUSBRAND shall cover the delivery costs related to the return. 5.2.3. AMOUNTS PAYABLE In addition to the delivery costs of returning the product, additional customs duties and taxes may be occur upon the shipment’s arrival in Hungary. The returner shall responsible for covering all additional costs arising in connection with the return. BOMBUSBRAND recommends that all returner contact their local customs office prior to sending the package in order to obtain further information regarding the customs obligations applicable in the destination country. |
| 5.2.4. ELÁLLÁSI JOG Az elállási jog a megrendelt termék(ek) kézhezvételétől számított 14 (tizennégy) napon belül gyakorolható. Az elállástól számítva a termékeket 14 (tizennégy) napon belül vissza kell küldeni a visszaküldési címre. A leírt határidőn túl visszaküldött termékekre nem vonatkozik a visszatérítés. A szállítási költség nem visszatérítendő. 5.3. Kizárt esetek Az 5.1. pontban leírt határidőn túl visszaküldött termékekre nem vonatkozik visszatérítés. Az egyszeri ingyenes méretcsere (5.4.2. pont) esetén a BOMBUSBRAND nem téríti vissza a termék árát. Felhívjuk figyelmét, hogy nem jogosult elállási jog gyakorlására, ha a terméket kifejezetten az Ön saját utasításai alapján, kifejezett kérésére készítették el, vagy ha a terméket egyértelműen az Ön személyére szabták. Felhívjuk figyelmét, hogy az elállási jogot csak fogyasztó gyakorolhatja, nem fogyasztónak minősülő szervezet (azaz vállalkozás) nem gyakorolhatja. 5.4. Csere 5.4.1. Általános csere Ha az elállási jog gyakorlása mellett a megrendelt terméket ki is szeretné cserélni, kérjük, jelezze ezt a megrendelt termék átvételétől számított 14 (tizennégy) napon belül küldendő nyilatkozatban, a fenti 5.1. pontban leírtak szerint. Ilyen esetben a jelen 5. pontban („Visszaküldési szabályzat”) foglalt rendelkezések, beleértve különösen a határidőket, a visszatérítés feltételeit és a kizárt eseteket, szintén érvényesek (megfelelő módosításokkal) a termék cseréjére. Ha cserét kíván végezni, a nem kívánt eredeti terméket vissza kell küldenie a visszatérítésért, és új rendelést kell leadnia (a szállítási költségek a vásárlót terhelik.). 5.4.2. Egyszeri ingyenes méretcsere A BOMBUSBRAND vásárlónként maximum egy alkalommal ingyenes méretcserét biztosít. Ebben az esetben a BOMBUSBRAND vállalja a csere vonatkozásában felmerült szállítási költségek megfizetését, tehát az eredetileg rendelt termék visszaküldése és az jó méret egyszeri elküldése vonatkozásában felmerült költségek megtérítését, amennyiben van a készleten Önnek megfelelő méretű termék. Felhívjuk a figyelmét arra, hogy ebben az esetben a BOMBUSBRAND nem téríti vissza az eredetileg rendelt termék vételárát, annak egy részét vagy a különbözetet. Visszatérítés kérése esetén ez a visszaküldési mód nem vehető igénybe és a BOMBUSBRAND nem vállalja a visszaküldés díjának megfizetését. Amennyiben Ön akciós méretet vásárolt, úgy a különbözet megfizetésére méretcsere esetén is köteles. Továbbá felhívjuk a figyelmét, hogy a méretcsere és a visszaküldés vonatkozásában a termék kézhezvételétől számítva 14 (tizennégy) napon belül előzetesen egyeztetni szükséges az order@bombusbrand.com e-mail címen! Az egyeztetés folyamán tájékoztatjuk, hogy lehetőség van-e a méretcserére, kell-e különbözetet fizetnie, továbbá tájékoztatást kap a visszaküldés menetéről is. A jó méret csak az eredetileg megrendelt termék hibátlan megérkezését követően kerül megküldésre a vásárló részére. Az eredetileg megrendelt termék BOMBUSBRAND-hez történő megérkezését követően a BOMBUSBRAND-nek 30 (harminc) napja van megvizsgálni az Ön által eredetileg megrendelt és visszaküldött terméket, hogy valóban hibátlan állapotban került-e visszaküldésre, illetve elküldeni az Ön részére az előzetes egyeztetések szerinti új méretet. 6. FELELŐSSÉG 6.1. Kellékszavatosság A „kellékszavatosság” azt jelenti, hogy hibás teljesítés esetén Ön jogosult a BOMBUSBRAND-del szemben a hibás termékek miatti kártérítési igényt érvényesíteni a Polgári Törvénykönyvben foglaltak szerint. Milyen jogok illetik meg Önt kellékszavatossági igénye alapján? Ön – választása szerint – az alábbi kellékszavatossági igényekkel élhet: Kérhet kijavítást vagy kicserélést, kivéve, ha az ezek közül az Ön által választott igény teljesítése lehetetlen vagy a vállalkozás számára más igénye teljesítéséhez képest aránytalan többletköltséggel járna. Ha a kijavítást vagy a kicserélést nem kérte, illetve nem kérhette, úgy igényelheti az ellenszolgáltatás arányos leszállítását, vagy a hibát a vállalkozás költségére Ön is kijavíthatja, illetve mással kijavíttathatja, vagy – végső esetben – a szerződéstől is elállhat. Fogyasztó és vállalkozás közötti szerződés esetén Ön a kellékszavatossági jogai gyakorlása keretében a hibát a vállalkozás költségére maga nem javíthatja ki, illetve mással sem javíttathatja ki azt. Választott kellékszavatossági jogáról egy másikra is áttérhet, az áttérés költségét azonban Ön viseli, kivéve, ha az indokolt volt, vagy arra a vállalkozás adott okot. Milyen határidőben érvényesítheti Ön kellékszavatossági igényét? Ön köteles a hibát annak felfedezése után haladéktalanul, de nem később, mint a hiba felfedezésétől számított kettő hónapon belül közölni. Ugyanakkor felhívom a figyelmét, hogy a szerződés teljesítésétől számított két éves elévülési határidőn túl kellékszavatossági jogait már nem érvényesítheti. Kivel szemben érvényesítheti kellékszavatossági igényét? Ön dr. Bakos-Molnár Lilla egyéni vállalkozóval szemben érvényesítheti kellékszavatossági igényét. Milyen egyéb feltétele van kellékszavatossági jogai érvényesítésének? A teljesítéstől számított egy éven belül a kellékszavatossági igénye érvényesítésének a hiba közlésén túl nincs egyéb feltétele, ha Ön igazolja, hogy a terméket, illetve a szolgáltatást a BOMBUSBRAND nyújtotta. A teljesítéstől számított egy év eltelte után azonban már Ön köteles bizonyítani, hogy az Ön által felismert hiba már a teljesítés időpontjában is megvolt. 6.2. Termékszavatosság Milyen esetben élhet Ön a termékszavatossági jogával? Ingó dolog (e pont alkalmazásában a továbbiakban: termék) hibája esetén Ön – választása szerint – kellékszavatossági jogát vagy termékszavatossági igényt érvényesíthet a Polgári Törvénykönyv szabályai szerint. Milyen jogok illetik meg Önt termékszavatossági igénye alapján? Termékszavatossági igényként Ön a hibás termék kijavítását vagy kicserélését kérheti. Kivel szemben érvényesítheti termékszavatossági igényét? Termékszavatossági jogait a termék előállítójával vagy forgalmazójával (a továbbiakban együtt: gyártó) szemben gyakorolhatja. Milyen esetben minősül a termék hibásnak? A termék akkor hibás, ha nem felel meg a forgalomba hozatalakor hatályos minőségi követelményeknek, vagy ha nem rendelkezik a gyártó által adott leírásban szereplő tulajdonságokkal. Milyen határidőben érvényesítheti Ön termékszavatossági igényét? Termékszavatossági igényét Ön a termék gyártó általi forgalomba hozatalától számított két éven belül érvényesítheti. E határidő elteltével e jogosultságát elveszti. Milyen bizonyítási szabály érvényesül termékszavatossági igény érvényesítése esetén? Termékszavatossági igény érvényesítése esetén Önnek kell bizonyítania, hogy a termékhiba a gyártó általi forgalomba hozatal időpontjában fennállt. A gyártó milyen esetben mentesül termékszavatossági kötelezettsége alól? A gyártó akkor mentesül termékszavatossági kötelezettsége alól, ha bizonyítani tudja, hogy – a terméket nem üzleti tevékenysége körében gyártotta, illetve hozta forgalomba, vagy – a hiba a tudomány és a technika állása szerint a forgalomba hozatal időpontjában nem volt felismerhető, vagy – a termék hibája jogszabály vagy kötelező hatósági előírás alkalmazásából ered. A gyártónak a mentesüléshez elegendő egy okot bizonyítania. Felhívom figyelmét, hogy Ön ugyanazon hiba miatt a vállalkozással szemben kellékszavatossági és a gyártóval szemben termékszavatossági igényt egyszerre, egymással párhuzamosan is érvényesíthet. Termékszavatossági igényének eredményes érvényesítése esetén a kicserélt termékre, illetve a termék javítással érintett részére vonatkozó kellékszavatossági igényét a továbbiakban már csak a gyártóval szemben érvényesítheti. 6.3. Egyéb kérdések A 6.1. és 6.2. ponttal kapcsolatban: A fenti 6.1. és 6.2. pontokban foglalt rendelkezések kizárólag a fogyasztókra vonatkoznak. (Fogyasztónak minősül az a magánszemély, aki szakmája vagy üzleti tevékenysége körében jár el. A nem fogyasztó vásárlókra a Polgári Törvénykönyv eltérő rendelkezései vonatkoznak.) 6.4. Felelősség korlátozása Felhívjuk figyelmét, hogy a BOMBUSBRAND nem vállal felelősséget azért, ha beszállítói nem teljesítik a BOMBUSBRAND-del szembeni kötelezettségeiket, vagy nem teljesítik a vonatkozó szerződés szerinti kötelezettségeiket. Felhívjuk figyelmét, hogy a BOMBUSBRAND nem vállal felelősséget a természetes értékcsökkenésből, gondatlan használatból vagy a termékleírásnak nem megfelelő egyéb kezelésből eredő károkért! A BOMBUSBRAND nem vállal felelősséget a késedelmes szállításért, ha azt az Ön által megadott helytelen és hiányos adatok okozták. A BOMBUSBRAND fenntartja a jogot, hogy az Önnel folytatott konzultációt követően részben vagy egészben megtagadja a visszaigazolt megrendelést. A BOMBUSBRAND semmilyen esetben sem felelős az előre nem látható károkért. A BOMBUSBRAND nem garantálja, hogy a Webáruház folyamatosan, megszakítások és hibák nélkül fog működni az internetkapcsolat vagy harmadik felek, például az adattárhely-szolgáltató felelősségi körébe tartozó körülmények miatt. 7. VEGYES 7.1. Panaszok A BOMBUSBRAND minden panaszát tárgyalások útján, békés úton kívánja rendezni. Rendeléssel kapcsolatos panaszát bármikor bejelentheti írásban a BOMBUSBRAND e-mail címén: order@bombusbrand.com, illetve nem rendeléssel kapcsolatos panaszát az alábbi e-mail címen: info@bombusbrand.com . A BOMBUSBRAND minden írásbeli panaszra haladéktalanul, de legkésőbb a kézhezvételtől számított 30 (harminc) napon belül írásban válaszol. Amennyiben a BOMBUSBRAND nem fogadja el a panaszát, részletesen indokolja azt. Alkalmazandó jog és joghatóság A jelen Általános Szerződési Feltételekre, valamint az Ön és a BOMBUSBRAND közötti szerződéses viszonyra a magyar jog az irányadó. Az Ön és a BOMBUSBRAND közötti bármilyen jogvitát az illetékes magyar bíróságok elé kell terjeszteni, kivéve, ha a jogügyletre hatályos fogyasztóvédelmi jogszabály másképp rendelkezik. 7.3. Szellemi tulajdon A Webáruházban található termékek és/vagy a BOMBUSBRAND termékeivel és szolgáltatásaival bármilyen módon kapcsolatos összes tartalom, például szövegek, logók, márkanév, grafika, design, képek, fényképek, videók, hanganyagok stb. a BOMBUSBRAND vagy tartalomszolgáltatóinak tulajdonát képezik, és szerzői jogi védelem alatt állnak. A termék megvásárlásával Ön nem szerez szellemi tulajdonjogot. 7.4. REFUND OPTIONS: Refund Following the receipt and inspection of the returned products, BOMBUSBRAND shall notify the returner on the approval or partial/entire rejection of your refund within 30 (thirty) days from the receipt of the returned products. In the event of the approval, BOMBUSBRAND shall refund the full or partial amount using the same payment method as used for the original transaction, unless You expressly agree to the use of a different payment method. The refund shall not include any delivery costs paid by You in connection with the return. All refunds shall be calculated based on the original purchase price of the Product. Delivery costs are non-refundable. 5.3. Excluded cases No refunds shall be provided for Products returned after the deadline specified in Section 5.1. In the case of a one-time free size exchange (Section 5.4.2), BOMBUSBRAND shall not refund the purchase price of the Product. Please note, that you are not entitled to exercise the right of withdrawal if the product was prepared especially upon your own specific instructions, on your expressed request, or if the product was clearly personalized for You. Please also note that the right of withdrawal cannot be exercised by a non-consumer entity (i.e. by business organizations). 5.4. Exchange 5.4.1. General Exchange If you wish to exchange the ordered product in addition to exercising your right of withdrawal, please notify us in writing within 14 (fourteen) days from the receipt of the ordered product, in accordance with the provisions set out in Section 5.1 above. In such cases, the provisions set out in this Section 5 (“Return Policy”), including in particular the applicable deadlines, conditions for refunds, and excluded cases, shall also apply to the exchange of Products, with the necessary modifications. If You wish to request an exchange, the original unwanted Product must be returned to receive a refund, and a new order must be placed (the delivery costs must be covered by the Customer). 5.4.2. One-Time Free Size Exchange BOMBUSBRAND provides a one-time free size exchange per Customer. In such cases, BOMBUSBRAND shall cover the delivery costs associated with the exchange, including the cost of returning the originally ordered Product and sending the replacement Product in the correct size, if the Product in the appropriate size is available in stock. Please note that in this case BOMBUSBRAND shall not refund the purchase price of the originally ordered Product, any part thereof, or any price difference. If a refund is requested, this return method shall not be available, and BOMBUSBRAND shall not cover the cost of the return. If You have purchased a size that was on sale, you are still required to pay the price difference when exchanging the product for a different size. Please also note that regarding the size exchange and the return, you must contact us in advance within 14 (fourteen) days from the receipt of the Product, via email at order@bombusbrand.com. During this consultation, BOMBUSBRAND shall inform You whether the size exchange is possible, whether any price difference is payable, and we provide instructions on the return process. The replacement Product in the correct size shall only be sent after the originally ordered Product has been received in a non-defective condition. BOMBUSBRAND shall have 30 (thirty) days from the receipt of the returned Product to inspect the Product to confirm that it has been returned in an undamaged condition, and to send the replacement Product in the correct size to You – in accordance with the prior consultation. 6. LIABILITY 6.1.Warranty for Defects The term “warranty for defects” (in Hungarian: “kellékszavatosság”) means that in the event of defective performance (in Hungarian: “hibás teljesítés”) you are entitled to make a claim for damages against BOMBUSBRAND in relation to the defective Products, in accordance with the provisions of the Hungarian Civil Code. What rights are you entitled to under a claim based on warranty for defects? You may, at your choice, exercise the following rights under the warranty for material defects: The Customer may request either repair or replacement, unless compliance with the chosen warranty right is impossible or it results in disproportionate expenses on the part of the Company. If the Customer did or could not request the repair or the replacement of the defective product, it may request a commensurate reduction in the price, or repair the product himself or have it repaired at the Company’s expense or to withdraw from the contract (as a last resort). In contracts between a Consumer and a business, the Consumer may not personally repair the defect, nor have it repaired by a third party at the Company’s expense. The Customer is entitled to switch from one chosen warranty rights to another; however, the costs arising from such a switch shall be covered by You, unless the switch was justified or caused by the Company. Within what time limit can you enforce a claim regarding the warranty? You shall notify BOMBUSBRAND about the defect without undue delay, after its discovery, but not later than within 2 (two) months from the date of its discovery at the latest. However, please note that Your right to make a claim for defective products shall lapse after 2 (two) years from the date of performance of the contract, you may no longer enforce your warranty rights. Against whom can you enforce your statutory warranty claim? You may enforce your claims against Dr. Bakos-Molnár Lilla, sole proprietor. What other conditions apply to the enforcement of your warranty rights? Within one (1) year from the date of performance, there are no further conditions for exercising your warranty rights other than notifying the Company of the defect, if You can prove that the product or service was supplied by BOMBUSBRAND. After the expiration of one (1) year from the date of performance, You are required to prove that the defect identified by You already existed at the time of performance.. 6.2. Product Warranty In what cases can You exercise your product warranty rights? In the event of a defect in a movable thing (hereinafter referred to as the “Product”), You may – at your choice – enforce either warranty claims for defects or product warranty claims in accordance with the provisions of the Hungarian Civil Code. What rights are you entitled under the Product Warranty claim? Under the product warranty claim, You may request the repair or replacement of the defective Product. Against whom can You enforce your product warranty claims? You may exercise your product warranty rights against the manufacturer or distributor of the Product (hereinafter collectively referred to as the “Manufacturer”). When is the product considered defective? The Product shall be deemed defective if it does not meet the quality requirements in effect at the time of placing the product on the market, or it does not meet the specifications provided by the manufacturer. Within what time limit can you enforce your product warranty claim? You may enforce your product warranty claim within two (2) years from the date the Product was placed on the market by the Manufacturer. After the expiration of this period, You lose the right to exercise such claims. What burden of proof applies when enforcing a product warranty claim? When enforcing a product warranty claim, You are required to prove that the defect in the Product already existed at the time it was placed on the market by the Manufacturer. In what cases is the Manufacturer exempt from product warranty liability? The Manufacturer shall be exempt from product warranty liability if it can prove that: the Product was not manufactured or placed on the market in the course of its business activities; or the defect was not recognizable according to the state of scientific and technical knowledge at the time the Product was placed on the market; or the defect in the Product results from the application of legislation or mandatory regulatory requirements. The Manufacturer is required to prove only one of the above grounds in order to be exempt from liability. Please note that, due to the same defect, You may enforce a statutory warranty claim against the Company and a product warranty claim against the Manufacturer simultaneously and in parallel. If your product warranty claim is successfully enforced, you may subsequently enforce your statutory warranty claim regarding the replaced Product or the part of the Product affected by the repair only against the Manufacturer. 6.3. Other Questions Regarding Sections 6.1 and 6.2: The above provisions in Sections 6.1 and 6.2 shall apply exclusively to consumers. (Consumer means a natural person acting outside his profession, independent occupation or business activity. Different provisions of the Hungarian Civil Code shall apply to non-consumer customers.) 6.4. Limitation of liability Please note that BOMBUSBRAND is not liable for the case when its suppliers do not fulfill their obligations towards BOMBUSBRAND or do not fulfill their obligations according to the relevant contract. Please note that BOMBUSBRAND shall not be liable for any damages resulting from normal wear and tear, negligent use, or any other handling not in accordance with the Product description. BOMBUSBRAND shall not be liable for late delivery if it was caused by incorrect and incomplete data provided by you. Following consultation with You, BOMBUSBRAND also reserves the right to partially or entirely refuse the confirmed order. BOMBUSBRAND shall not be liable in under any circumstances for unforeseeable or indirect damages. BOMBUSBRAND does not guarantee that the Webshop will operate continuously without any interruptions and errors, due to circumstances beyond its control, including but not limited to internet connectivity issues or matters within the responsibility of third parties, such as data hosting providers. 7. MISCELLANEOUS 7.1. Complaints BOMBUSBRAND aims to resolve all complaints amicably through negotiations. Any order-related complaint may be submitted in writing at any time to order@bombusbrand.com, and any non-order-related complaint may be submitted to info@bombusbrand.com. BOMBUSBRAND shall respond in writing to all written complaints without undue delay, but no later than thirty (30) days from the receipt. If BOMBUSBRAND does not accept the complaint, it shall provide detailed reasoning. Any legal dispute between You and BOMBUSBRAND shall be submitted to the competent Hungarian courts, unless applicable consumer protection legislation provides otherwise. 7.3. Intellectual Property All content/ products available in the Webshop, and any content related in any way to BOMBUSBRAND products and services, including but not limited to texts, logos, brand names, graphics, designs, images, photographs, videos, and audio materials, etc. are the property of BOMBUSBRAND or its content providers and are subject to copyright protection.
